End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("Licensee" or "you") and Solve DevOps Pty Ltd ("Licensor", "we", "our", or "us") for the use of the software product "sftproo" including all associated components, features, and documentation (the "Software").
By downloading, installing, or using the Software, you agree to be bound by the terms of this Agreement.
1. License Grant
We grant you a limited, non-transferable, revocable license to use sftproo for either commercial or personal purposes. You may not resell, sublicense, or reverse engineer the Software. This license is provided solely for your internal use.
2. License Restrictions
You shall not:
- Copy, modify, or create derivative works based on the Software;
- Sublicense, lease, rent, or otherwise distribute the Software;
- Use the Software for any unlawful purpose;
- Use the Software to develop or enhance competing products.
3. Intellectual Property
All rights, title, and interest in and to the Software, including all intellectual property rights, remain with us. No ownership rights are transferred to you under this Agreement.
4. User Obligations
You are responsible for securing access credentials, complying with applicable laws and regulations, and ensuring that your use of sftproo does not infringe upon the rights of others. You accept full responsibility for any use or misuse of the Software on your systems.
5. Privacy and Data Use
The Software may collect limited technical and usage data solely for the purpose of improving user experience and product development. For more details, please refer to our Privacy Policy.
6. Support and Updates
Support is provided only to users who have procured the Software via the AWS or Azure Marketplace. Updates, patches, and security notices will be posted on our official website. Marketplace users will receive priority notification and access.
7. Warranties and Disclaimers
The Software is provided "AS IS" and "AS AVAILABLE", with no warranties of any kind. We make no guarantees as to uptime, reliability, security, or fitness for any particular purpose. You use the Software entirely at your own risk.
8. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages—including but not limited to data loss, business interruption, or financial loss—arising out of the use or inability to use the Software.
9. Termination
This Agreement is effective until terminated. You may terminate it at any time by ceasing to use the Software. We reserve the right to terminate your license immediately if you breach any of the terms in this Agreement. Upon termination, you must cease all use of the Software.
10. Export Compliance
You agree to comply with all applicable export laws and regulations and shall not export, re-export, or transfer the Software in violation of such laws, including those of Australia and other relevant jurisdictions.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles.
12. Third-Party Components
The Software may include or link to third-party open-source software components, which are licensed under their respective licenses. We make no claim over these third-party components. Use of such components is subject to the licensing terms provided by the respective rights holders.
By using the Software, you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions of this EULA.
